Legal Bases for Stockpiling and Crisis Preparedness

The stockpiling of crude oil, petroleum products, and biogenic raw materials and fuels follows national, European, and international requirements. These regulate, among other things, the stockpiling obligation, the tasks of the central stockpiling agency, and the release of strategic reserves during supply crises. Austria maintains stocks of crude oil, petroleum products, and biogenic raw materials and fuels for potential supply shortages. These reserves help to maintain energy supplies for a limited period during crisis situations.

Here you will find the most important legal sources as well as information on current and past energy intervention measures.

The legal bases define the tasks of the ELG and the obligations of companies subject to stockpiling requirements. The following documents are available for further information.

National Legal Bases
Crude Oil Stockpiling Act 2012 – EBG 2012

The Crude Oil Stockpiling Act regulates the holding of minimum stocks of crude oil and petroleum products. Among other things, it contains provisions on entities subject to stockpiling obligations, the scope and fulfillment of these obligations, imports, reporting, storage, and inspections.

Energy Intervention Powers Act 2012 – EnLG 2012

The Energy Intervention Powers Act provides the legal basis for measures to secure energy supplies when market measures are insufficient or a supply disruption is imminent.

Biofuel Stockpiling Ordinance 2007

The ordinance contains supplementary provisions for the stockpiling of biofuels and raw materials used for the direct production of biofuels.

Crude Oil Statistics Ordinance 2011

The regulation governs the collection and transmission of statistical data on crude oil and petroleum products. It contains specific provisions regarding the companies subject to reporting, the data to be collected, the content and deadlines for reports, and the transmission and processing of such reports.

European and international foundations
Agreement on an International Energy Program

The international agreement of November 18, 1974, forms a basis for cooperation in securing energy supplies.

EU Stockpiling Directive 2009/119/EC

The directive requires European Union member states to maintain minimum stocks of crude oil and petroleum products.

EU Implementing Directive 2018/1581

EU Implementing Directive 2018/1581 supplements the EU Stockpiling Directive and specifically regulates the methods for calculating stockpiling obligations.

Energy management measures

Energy management measures are designed to secure the supply of the Austrian market in a crisis situation or in the event of a severe shortage. The competent authority may order the release of mandatory emergency reserves for this purpose.

The ELG implements these orders within the specified scope and timeframe.
